Terms of Service
These Terms of Service ("Terms") govern your use of Send (send.withmagic.ai), operated by WithMagic ("we," "us," or "our"). By creating an account or using Send, you agree to these Terms. If you don't agree, please don't use the service.
What Send Does
Send is an AI-powered gift concierge. When you connect your Google account, we read birthday dates and names from your contacts, then email you curated gift suggestions before each birthday. You can also use our on-demand gift wizard to find and send gifts anytime.
We do not purchase, ship, or fulfill gifts directly. When you click a gift link, you're taken to Amazon or another retailer where you complete the purchase yourself.
Your Account
You sign in to Send using Google OAuth. By connecting your Google account, you authorize us to access the specific data described in our Privacy Policy (names and birthday dates from your contacts).
- You must be at least 18 years old to use Send.
- You're responsible for the activity on your account.
- You agree to provide accurate information and keep your account secure.
- One account per person. Don't share your login or create multiple accounts.
Acceptable Use
You agree not to:
- Use Send for any unlawful purpose or to violate any laws.
- Attempt to access another user's account or data.
- Scrape, crawl, or automatically extract data from Send.
- Interfere with the service's operation or infrastructure.
- Use Send to send spam or unsolicited messages to anyone.
- Reverse-engineer, decompile, or attempt to extract source code from Send.
Affiliate Disclosure
Send is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by linking to Amazon.com. When you purchase a gift through one of our links, we may earn a small commission at no additional cost to you.
This is how Send stays free. You never pay more than the listed price on Amazon.
Third-Party Services
Send integrates with and links to third-party services. Each has its own terms and privacy policies:
- Google — We use Google OAuth for sign-in and access your contacts for birthday data. Subject to Google's Terms of Service.
- Amazon — Gift links direct you to Amazon. Purchases are governed by Amazon's Conditions of Use.
- Handwrite.io — We may use Handwrite.io for handwritten note services in the future. Any such use will be subject to their terms.
We are not responsible for the practices, content, or availability of these third-party services.
Intellectual Property
Send, its design, branding, text, and code are owned by WithMagic. You may not copy, modify, or redistribute any part of Send without written permission.
Your data remains yours. We don't claim ownership of the information you provide through your Google account.
Service Availability
Send is currently in beta. We do our best to keep the service running, but we don't guarantee 100% uptime. We may modify, suspend, or discontinue features at any time. We'll try to give you notice when possible, but beta means things can change.
Limitation of Liability
Send is provided "as is" without warranties of any kind, whether express or implied. To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of Send.
- We are not responsible for products you purchase through affiliate links. Those transactions are between you and the retailer.
- We are not responsible for the accuracy of gift suggestions or birthday date information imported from your contacts.
- Our total liability to you for any claim related to Send is limited to the amount you paid us in the 12 months before the claim (which, during the free beta, is $0).
Termination
You can delete your account at any time from your dashboard. When you delete your account, we remove your data as described in our Privacy Policy.
We may also suspend or terminate your account if you violate these Terms or if we need to discontinue the service. We'll notify you by email if we do this.
Disputes
These Terms are governed by the laws of the State of California, United States. Any disputes will be resolved in the courts located in San Francisco County, California. You agree to attempt to resolve any dispute informally by contacting us before filing a formal claim.
Changes to These Terms
We may update these Terms from time to time. When we make changes, we'll update the "Last updated" date at the top. If the changes are significant, we'll notify you by email. Continued use of Send after changes means you accept the updated Terms.
